TERMS OF SERVICES
By using the Sol Tec service, you have consented to the Sol Tec TERMS OF SERVICES (TOS). We reserve the right, at our discretion, to add, to modify, or to remove portions of this policy at any time. Please check this page periodically for changes. Your continued usage of the Sol Tec service following the posting of changes to these terms shall imply your acceptance of the said changes. Customer Conduct
(a) The Internet Connection services as offered and provided under the Terms of Service are offered for the use of paid Customers only. Customer will not resell or redistribute (whether for a fee or otherwise) the Sol Tec service, or any portion thereof, or otherwise charge others to use the Sol Tec service, or any portion thereof. Customer agrees not to use Sol Tec service for operation as an Internet service provider, for the hosting of websites (other than as expressly permitted as part of an individual contract) or for any enterprise purpose whether or not the enterprise is directed toward making a profit.
(b) Customer acknowledges that Customer is responsible for and assumes all risks with respect to whether materials uploaded, posted or otherwise made available on or via Sol Tec service through Customer's account may violate any laws or rights.
You agree to not use the Service to:
a. upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tourtious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
b. harm minors in any way;
c. impersonate any person or entity, including, but not limited to, a Sol Tec official, forum leader, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;
d. forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;
e. upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
f. upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights ("Rights") of any party;
g. upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except in those areas (such as shopping rooms) that are designated for such purpose (please read our complete Spam Policy);
h. upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
i. disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other Customers of the Service are able to type, or otherwise act in a manner that negatively affects other Customers' ability to engage in real time exchanges;
j. interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
k. intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law;
l. provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act;
m. "stalk" or otherwise harass another; or
n. collect or store personal data about other Customers.
You acknowledge that Sol Tec may or may not pre-screen Content, but that Sol Tec and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or move any Content that is available via the Service. Without limiting the foregoing, Sol Tec and its designees shall have the right to remove any Content that violates the TERMS OF SERVICES or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by Sol Tec or submitted to Sol Tec, including without limitation information in Sol Tec, and in all other parts of the Service.
You acknowledge, consent and agree that Sol Tec may access, preserve, and disclose your account information and Content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the TERMS OF SERVICES ; (c) respond to claims that any Content violates the rights of third-parties; (d) respond to your requests for customer service; or (e) protect the rights, property, or personal safety of Sol Tec, its Customers and the public.
You understand that the technical processing and transmission of the Service, including your Content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
You understand that the Service and software embodied within the Service may include security components that permit digital materials to be protected, and use of these materials is subject to usage rules set by Sol Tec and/or content providers who provide content to the Service. You may not attempt to override or circumvent any of the usage rules embedded into the Service. Any unauthorized reproduction, publication, further distribution or public exhibition of the materials provided on the Service, in whole or in part, is strictly prohibited.
Indemnity
You agree to indemnify and hold Sol Tec, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or make available through the Service, your use of the Service, your connection to the Service, your violation of the TERMS OF SERVICES or your violation of any rights of another.
Links to Other Sites
Customers should be aware that when they are on Sol Tec sites they could be directed to other sites that are beyond our control. There are links to other sites from Sol Tec sites that take you outside our service. For example, if you click on a banner advertisement or a Sol Tec search result, the click takes you off the Sol Tec site. This includes links from advertisers, sponsors and partners that may use Sol Tec's logo as a part of a co-branding agreement. These other sites may send their own cookies to Customers, collect data, or solicit personal information. Always be aware of where you end up.
Please keep in mind that whenever you give out personal information online -- for example, via message boards or chat -- that information can be collected and used by people you don't know. While Sol Tec strives to protect its Customers' personal information and privacy, we cannot guarantee the security of any information you disclose online and you do so at your own risk.
Provider Domains
As an Internet Service Provider (ISP), Sol Tec provides hosting for companies which are in no way affiliated with Sol Tec. Customers may encounter web addresses which appear to be hosted at the Sol Tec domain, but which are not under our control: http://www.soltec.net/company.
Unsolicited Email Policy (Spam)
Sol Tec ("Sol Tec") does not authorize the use of its proprietary computers and computer network (the Sol Tec Network") to accept, transmit or distribute unsolicited bulk e-mail sent from the Internet to Sol Tec members. In addition, Internet e-mail sent, or caused to be sent, to or through the Sol Tec Network that makes use of or contains invalid or forged headers, invalid or non-existent domain names or other means of deceptive addressing will be deemed to be counterfeit. Any attempt to send or cause such counterfeit e-mail to be sent to or through the Sol Tec Network is unauthorized. Similarly, e-mail that is relayed from any third party's mail servers without the permission of that third party, or which employs similar techniques to hide or obscure the source of the e-mail, is also an unauthorized use of the Sol Tec Network. Sol Tec does not authorize anyone to send e-mail or cause e-mail to be sent to the Sol Tec Network that violates Sol Tec's Terms of Service. Sol Tec does not authorize the harvesting or collection of login names from the Sol Tec service for any purpose. Sol Tec reserves the right to take all legal and technical steps available to prevent unsolicited bulk e-mail or other unauthorized e-mail from entering, utilizing or remaining within the Sol Tec Network. Nothing in this policy is intended to grant any right to transmit or send e-mail to, or through, the Sol Tec Network. Sol Tec's failure to enforce this policy in every instance in which it might have application does not amount to a waiver of Sol Tec's rights.
Unauthorized use of the Sol Tec Network in connection with the transmission of unsolicited bulk e-mail, including the transmission of counterfeit e-mail, may result in civil and criminal penalties against the sender, including those provided by the Computer Fraud and Abuse Act (18 U.S.C. § 1030 et seq.); the Virginia Computer Crimes Act (Va. Code Ann. § 18.2-152.2 et seq.) (amended effective July 1, 1999); and the Washington Commercial Electronic Mail Act ( Wash. Rev. Code Chapter 19.190 et seq.).
Security Policy
The importance of security for all personally identifiable information associated with our Customers is of utmost concern to us. We exercise care in providing secure transmission of your information from your computer through our network.
Only those employees who need access to your information in order to do their jobs are allowed access, each having signed comprehensive nondisclosure agreements with Sol Tec, which provide explicit legal confidentiality protections. Any employee who violates our privacy and/or security policies is subject to disciplinary action, including possible termination and civil and/or criminal prosecution.
Security Violations
Sol Tec Services may not be used to interfere with, to gain unauthorized access to or otherwise violate the security of Sol Tec’s or another's server, network, personal computer, network access or control devices, software or data, or other system, or to attempt to do any of the foregoing. Examples of Security Violations include but are not limited to:
- intercepting, interfering with or redirecting e-mail intended for third parties, or any form of network monitoring, scanning or probing, or other action for the unauthorized interception of data or harvesting of e-mail addresses;
- attempting to attack, breach, circumvent or test the vulnerability of the Customer authentication or security of any host, network, server, personal computer, network access and control devices, software or data (except in the case of authorized legitimate network security operations);
- using any program, file, script, command or the transmission of any message or content of any kind, designed to interfere with a terminal session or the access or use of the Internet or any other means of communication;
- distributing or using tools designed to compromise security, including cracking tools, password guessing programs, packet sniffers or network probing tools (except in the case of authorized legitimate network security operations);
- falsifying packet header, sender, or Customer information whether in whole or in part to mask the identity of the sender, originator or point of origin; and
- distributing viruses, worms, trojan horses or other harmful software.
File and Print Sharing
The Service functions in some ways as a Local Area Network (LAN) with each Customer constituting a node on the network. As such, other parties outside of the Premises may be able to access the Customer Equipment and other equipment connected in some way to the Customer Equipment. In addition, some available software includes capabilities that will permit other parties to gain access to the Customer Equipment and other equipment connected in some way to the Customer Equipment, and to the software, files and data stored on such equipment. For example, operating systems such as Windows and Macintosh include file sharing and print sharing capabilities which, when enabled, will permit others to gain access to Customer Equipment, even if a Customer is not using the Service. Sol Tec recommends that Customers disable file and print sharing and other capabilities that allow outside parties to gain access to the Customer Equipment. Customers acknowledge that if Customer chooses to run such applications, Customer should take appropriate security measures, and that any failure by Customer to follow this recommendation is at Customer's sole risk. Neither Sol Tec nor its affiliates shall have any liability whatsoever for any claims, losses, actions, damages, suits or proceedings resulting from, arising out of or otherwise relating to access by others of the Customer Equipment or any other equipment connected in some way to the Customer Equipment, or to the software, files and data stored on such equipment.
Prohibited Actions
Sol Tec is committed to remaining in compliance with laws and regulations governing use of the Internet and e-mail transmissions, and to preserving for all of its Customers the ability to use Sol Tec’s network and the Internet without interference or harassment from other Customers. Sol Tec prohibits use of all its Services in any ways that are unlawful, interfere with use of Sol Tec’s network or the Internet, infringe intellectual property rights, result in the publication using Sol Tec Services of threatening or offensive material, constitute Spam/E-mail/Usenet abuse, or present security or privacy risks.
Eavesdropping
Sol Tec's facilities are used by numerous persons or entities including, without limitation, other Customers to the Service. As a result, there is a risk that Customers could be subject to "eavesdropping." This means that other persons or entities may be able to access and/or monitor a Customer's use of the Sol Tec Services. Any sensitive or confidential information posted, stored, transmitted or disseminated by Customer is done so at Customer's sole risk, and neither Sol Tec nor its affiliates shall have any liability whatsoever for any claims, losses, actions, damages, suits or proceedings arising out of or otherwise relating to such actions by Customer. Customers acknowledge that software programs claiming to be capable of encryption are commercially available. Sol Tec makes no representation or warranty regarding the effectiveness of such programs.
FTP/HTTP Service Setup
Customer acknowledges that when using the Service there are certain applications such as FTP (File Transfer Protocol) server or HTTP (Hyper Text Transfer Protocol) server, which may be used by third parties to allow such parties to gain access to Customer's Equipment. Customer is solely responsible for the security of the Customer Equipment or any other equipment Customer chooses to use in connection with the Sol Tec services, including without limitation any data stored on such equipment. Neither Sol Tec nor its affiliates shall have any liability whatsoever for any claims, losses, actions, damages, suits or proceedings resulting from, arising out of or otherwise relating to the use of such applications by Customers, or the access by others to the Customer Equipment or other equipment of Customer.
Eligibility
To become a member of the Service, you have to be at least eighteen years old. You must also register using your own name. Customer further represents and warrants:
(i) Customer Information. The Customer information that Customer has provided and will provide to Sol Tec during the term of this Agreement, including, without limitation, Customer's legal name, address, telephone number(s), the number of computers on which the Service is being accessed and payment data (including, without limitation, credit or debit card numbers and expiration dates) is accurate, complete and current. If Customer uses a credit or debit card for payment, Customer must provide the credit or debit card account number that is issued in the Customer's name and that the Customer is authorized to use. Customer agrees to promptly notify Sol Tec if there is any change in the information that Customer has provided to Sol Tec. Failure to provide and maintain accurate information constitutes a breach of this Agreement.
Billing and Payment:
Customer shall pay the fees by the first of every month. Sol Tec shall send statements via your email account indicated at the time of sign up. If customer chooses to receive statements through the Postal system, a $1 monthly fee will be charged. If the past due for more than thirty (30) days, Sol Tec may suspend, interrupt or disconnect the Services with no additional notice to Customer. In the event of such suspension, interruption or disconnection, Customer may be required to post a deposit or such other security, as Sol Tec reasonably deems necessary in order to resume receiving the Services. In addition, if after two or more payment defaults Sol Tec reasonably determines that Customer is not creditworthy or financially secure, Sol Tec may require payment in advance or some other form of assurance to secure Customer’s payment obligations hereunder. Customer may not withhold or set off any payment for any reason without Sol Tec’s prior written consent, except in the event of a billing dispute, in which event Customer shall have provided Sol Tec with written notice of the details of the billing dispute, together with all supporting documentation within fifteen days of receiving the statement, and shall be working with Sol Tec in good faith to resolve the dispute. Sol Tec shall have no liability for any loss or damage resulting from its suspension of termination of Services under this Agreement.
Pre-payments
Sol Tec offers 12 and 6 months memberships for dial-up services and H.A.L.O services. The offers are at reduced rates for the customer paying in advance as a package. The customer may elect to discontinue services prior to the ending date of respective package with no refund given. All billing disputes should be sent to the Sol Tec Billing department.
Sol Tec reserves the right to disconnect customers, at Sol Tec's discretion, who abuse or overuse bandwidth, NOT abiding by the above terms or is delinquent on payments. Sol Tec reserves the right to contact appropriate authorities if suspicious or potentially illegal activities are detected on our network.
Theft
If at anytime Sol Tec detects an individual on its network that has not registered and/or paid for said services, Sol Tec reserves the right to conduct an investigation and use whatever means necessary to ensure the security of our network for our customers and business. Sol Tec will also contact local or federal authorities to assist in an investigation that will prosecute to the fullest extent of the law.
Hindrance beyond Sol Tec Control
Sol Tec shall not be responsible for performance of its obligations hereunder where delayed by war, riots, embargos, strikes, interruptions in telecommunications services, acts or omissions of its vendors or suppliers or other third parties, accidents, acts of God, terrorism, or any other event beyond Sol Tec's control.
Notice
Sol Tec may provide you with notices, including those regarding changes to the TERMS OF SERVICES, by either email, regular postal mail, or postings on the Policy Page on our web site.
Sol Tec reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrong. Such cooperation may include, but not be limited to, provision of account or user information or email as well as monitoring of the Sol Tec network
